"That's what the American Civil Liberties Union thinks. Electronic medical records provisions are common elements of this year's proposed health care reform legislation. However, ACLU says that electronic medical records raise serious privacy concerns. ACLU believes that patients must be able to maintain control over their electronic medical records.
According to ACLU, the State of California is undertaking an effort to place all Californians' medical records into a giant electronic database called a "health information exchange."
ACLU says that California's current proposal is to include everyone's records unless the person opts out of the system. ACLU believes that, in order to maintain our individual control over our records, we should have to opt in to be included.
The California Security and Privacy Advisory Board is drafting the guidelines, and has sought public comment on its proposals. The deadline to comment is today, December 1. ACLU has created a form to submit such comments, with talking points that you can edit any way you like. Alternatively, you can email your own comments to psab@ohi.ca.gov.
If you are a Californian and have an opinion one way or another regarding the privacy of your health and medical information in the digital age, it's important to let California's government know how you feel. If you are located in another state, it would be a good idea to stay similarly informed and involved about the privacy status of your health and medical records."
